1. Who you're contracting with

These Terms & Conditions ("Terms") are a binding agreement between you and Diggys ("Diggys", "we", "us"), the operator of the Diggy Rollers game and website (the "Service"). By creating an account or using the Service, you agree to these Terms.

2. Eligibility

You must be at least 13 years old (or the minimum age in your country) to use the Service. If you are under the age of majority where you live, you confirm that a parent or legal guardian agrees to these Terms on your behalf.

3. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

• No unlawful, fraudulent, or abusive use of the Service.
• No spamming, harassing, or sending malicious content to other players.
• No reverse engineering, scraping, probing, or interfering with the Service or its security.
• No infringement of our or anyone else's intellectual property.
• No cheating, exploiting bugs, automated play, or unauthorized modifications.

5. Intellectual property

The Service, including all game art, characters, code, branding, and content, is owned by Diggys and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and play the Service for personal, non-commercial use.

6. Virtual items and coins

Coins, Diggys, potions, and other in-game items have no real-world value, are not redeemable for cash, and remain our property. You receive a limited license to use them inside the Service only. We may modify, remove, or rebalance items at any time.

7. Payments — Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By making a purchase, you also agree to Paddle's Checkout Buyer Terms.

8. Refunds

Refunds are handled in accordance with our Refund Policy and Paddle's refund handling.

9. Service availability

We work hard to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available" to the fullest extent permitted by law.

10. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

11. Disclaimers and liability

To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our aggregate liability for any claim arising from the Service is capped at the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or special damages. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify and hold Diggys harmless from claims arising out of your misuse of the Service, your content, or your violation of these Terms.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-laws rules.
